Terms & Conditions

§ 1

1. Toscana Forum - hereinafter referred to as intermediary - is an entrepreneurial initiative of Elisa Santoni, an internet travel agency, based in Unterföhring near Munich.

2. The agent arranges the rental of selected holiday apartments, rooms, villas and holiday homes in the name and for the account of the respective landlord providing accommodation - hereinafter referred to as the landlord.

3. The agent communicates the respective seasonal price list on his official website (www.toscana-forum.de). The brokerage takes place at these prices free of commission for the tenant.

4. The rental agreement is concluded between the person seeking accommodation - hereinafter referred to as the tenant - and the landlord through the acceptance of the tenant's binding commitment by the agent on behalf of the landlord.

5. The rental property may only be occupied by the number of people specified in the rental agreement. The landlord reserves the right to charge extra people separately or to reject them.

6. The tenant is obliged to treat the rental property with care. He is liable to the landlord for damage caused by him and/or his children and/or his guests.

7. The tenant accepts the respective house rules.

8. Pets may only be taken with you with the express written permission of the landlord.

§ 2

1. The tenant offers the landlord a binding rental agreement via the agent through a binding written confirmation (fax/e-mail/post).

2. The rental agreement is concluded through the acceptance of the tenant's binding commitment by the agent on behalf of the landlord.

3. The tenant signs the rental agreement and sends it completely filled out together with a copy of the payment or transfer receipt for the entire down payment amount to the agent (fax / email / post). In the case of a fax or scanned copy that is difficult to read, duplicate copies of the documents must be sent to the agent by post.

4. The tenant then receives back from the agent a copy of the rental agreement signed by the agent on behalf of the landlord with booking confirmation and at the same time an information sheet regarding the landlord and the rented property (fax / e-mail / post).

5. In the event that the deposit amount is not received on time after the agent has sent the rental agreement, i.e. within 8 days from the rental agreement date / p. 1 of the rental agreement) to the agent's account, the agent is authorized to do so by the landlord after a one-time unsuccessful payment reminder to cancel the tenant's reservation.

6. In this case, the tenant bears the costs of loss of rent.

§ 3

1. The agreed deposit is due when the rental agreement is concluded or when the rental agreement is returned by the tenant.

2. The amount of the deposit is stated on the first page of the rental agreement.

3. The bank details can be found in Section 5 of these General Terms and Conditions.

4. The rental agreement specifies the payment method for the remaining rental amount. It is determined there whether payment must be made on site to the landlord, by credit card or by bank transfer.

5. Additional costs (e.g. additional bed, heating, etc.) can be paid either via the agent or directly on site to the landlord, depending on the agreement.

6. The agent is also authorized to collect debts on behalf of the landlord.

§ 4

1. All services ordered by the tenant when booking are taken into account when determining the total rental price.

2. Additional services that are only agreed and ordered on site between the tenant and the landlord must be paid for there before the key and deposit are returned to the attention of the landlord.

§ 5

In the event that fees are incurred for the transfer, these will be borne by the tenant. When making the transfer, the name of the tenant, period and property name must be stated.

§ 6

The tenant presents his passport or ID card upon arrival.

§ 7

1. There is no uniform rental deposit amount as this is determined differently by the respective landlord. Therefore, the amount of the rental deposit can only be determined by the rental agreement.

2. The rental deposit is paid upon arrival and before the keys are handed over to the attention of the landlord or the agent appointed by him.

3. The rental deposit will be refunded to the tenant on the day of departure after the keys have been returned.

4. In the event of damage caused by the tenant and/or his family members and/or guests during the agreed rental period, the necessary repair costs will be offset against the rental deposit.

5. If the rental deposit amount is not sufficient to repair the damage, the additional amount required will be paid by the tenant in cash on site and before departure.

§ 8

1. The rental property is generally available for the tenant to take over from 16 p.m. to 19 p.m. on the day of arrival. However, there is no uniform period and it varies from landlord to landlord. The exact time frame is regulated in the rental agreement.

2. In the event of a later arrival, the tenant must inform the landlord in good time and agree on an arrangement acceptable to the landlord with the landlord. An earlier arrival must also be agreed with the landlord.

3. On the day of departure, the rental property must generally be released for cleaning by 10 a.m. However, there is no uniform period and it varies from landlord to landlord. The exact time frame is regulated in the rental agreement.

4. The tenant must report in good time before departure in order to accept the rental property.

§9 Cancellation, rebooking, cancellation insurance

The tenant is entitled to withdraw from the contract before the start of the rental period. In the event of such a withdrawal, the landlord – through the agent – ​​will claim compensation. The exact amount of compensation and the processing are regulated in the rental agreement. The amount of compensation is determined by the individual landlords and varies greatly depending on the property booked:

Some landlords generally only require the deposit as cancellation costs up to 14 days before arrival, others up to 8 days before arrival.

If there is no specific information about cancellation costs, customers can inquire at Toscana Forum. There may be deviations from the above models from landlord to landlord. The complete and valid cancellation table can be found in the signed rental agreement.   

The tenant is expressly permitted to prove that no damage occurred at all or that it was significantly lower than the cancellation fee. The tenant has the right to provide a replacement tenant who will take over the apartment in full. A processing fee of €100 may be charged for this. Cancellation fees will then not be charged. In all other rebooking cases, a fee of €30-50 may be charged.

§ 10

1. The agent's website contains information and descriptions of the selected rental properties and other information (e.g. event calendar, etc.). However, there is no guarantee that all information is correct, as some of it is based on information from third parties or from landlords, transport offices and similar institutions.

2. In the event of force majeure (natural disaster, war, strike, etc.), the landlord reserves the right to terminate the rental agreement. Rent payments made to the landlord directly or through the agent will be refunded by the landlord. Any further claims are excluded.

3. If the reserved rental property is not available, the landlord reserves the right to offer the tenant another rental property of comparable quality. If the landlord cannot offer a comparable rental property, the landlord will reimburse the tenant for the rental payments made to the landlord directly or through the agent. Any further claims are excluded.

4. The assignment of claims from the rental agreement to third parties, which also includes spouses and family members, is excluded.

§ 11

1. In the event of defects or complaints, the tenant must contact the landlord directly, as his sole contractual partner.

2. If no remedy is possible, the tenant has the option of contacting the agent. He will endeavor to act as an intermediary.

3. Reports of defects after the holiday has ended are excluded.

§ 12

1. German law applies.
2. Place of jurisdiction is Munich.
